Oshi Terms and Conditions

Welcome to Oshi, a mobile app and web application provided by Logcast AB, accessible through the website oshi4ever.com and our mobile app (collectively, the "Service"). By using the Oshi service, you agree to be bound by the following terms and conditions ("Terms of Service").
1. Basic Terms & Community Guidelines
- You must be at least 13 years old to use Oshi.
- You are responsible for all activities conducted under your account.
- Safeguard your password to maintain account security.
- Do not engage in abusive, harassing, threatening, impersonating, or intimidating behavior towards other Oshi users.
- Comply with all applicable laws in your use of Oshi.
- Do not impersonate others or steal their identity.
- Do not use Oshi for illegal or unauthorized purposes. International users must adhere to local laws governing online conduct and content.
- You are solely responsible for your behavior and any content (text, data, information, images, photos, profiles, audio, links, etc.) you create, post, or display on Oshi.
- By using our services and application, you agree not to engage in abusive behavior or submit objectionable content. We reserve the right to monitor and take appropriate action against any user found in violation of this policy. Your continued use of the app constitutes your acceptance of these terms.
- Do not modify, adapt, or attempt to hack Oshi or mislead others by falsely associating it with Oshi.
- Access Oshi's private API only through the official Oshi application.
- Do not send spam, transmit worms, viruses, or destructive code.
- Violation of these agreements may result in the termination of your Oshi account. While we prohibit such behavior and content, you acknowledge that Oshi cannot control all content and interactions, and you use the service at your own risk.
2. General Conditions
- We reserve the right to modify or terminate Oshi for any reason without notice.
- We may update these Terms of Service, and material changes will be communicated according to your account preferences.
- We reserve the right to refuse service to anyone at any time.
- Inactive, trademark-violating, or misleading usernames may be forfeited.
- We may remove content and accounts that violate these Terms of Service or are deemed unlawful, offensive, threatening, libelous, defamatory, obscene, or infringing on intellectual property rights.
- We may reclaim usernames for businesses or individuals with legal claims or trademarks.
- We can terminate or suspend your account at our discretion and remove content as needed.
- You may not file a claim against us for suspending or terminating your account, and you agree to cover any associated damages, including legal fees. These terms remain in effect even if you no longer have an Oshi account.
3. Proprietary Rights in Content on Oshi
- Oshi does not claim ownership of the content (text, audio, images, photos, sounds, works, etc.) you post.
- By posting content on Oshi, you grant us a non-exclusive, worldwide, royalty-free license to use, modify, publicly perform, display, reproduce, and translate the content on our platforms.
- You represent that you own or have the right to grant this license and that your content does not violate any third-party rights.
- You may use Oshi's content for personal viewing but may not copy, modify, publish, distribute, or sell it.
- Oshi may perform technical functions necessary for service delivery, including content transcoding and reformatting.
- While Oshi is usually available, it may be temporarily interrupted for maintenance, upgrades, emergency repairs, or uncontrollable telecommunication failures. Deleted content may be stored as required by law, but Oshi is not a backup service.
4. Assumption of Risks
- Engaging in any purchase, sale, acceptance, or facilitation of transactions outside of the Oshi platform is entirely at your own risk. By doing so, you acknowledge that you have gathered sufficient information to make an informed decision. Oshi does not oversee or endorse transactions outside of Oshi platform and explicitly disclaims any liability or obligation to indemnify or protect you from any losses incurred while engaging in such transactions.
- Certain sections of the Oshi platform may feature third-party content, data, information, applications, or materials ("Third Party Materials"). By using the Oshi platform, you understand and agree that Oshi assumes no responsibility for examining or assessing the accuracy, completeness, legality, or quality of these Third Party Materials. Oshi does not endorse or warrant any third-party services or materials and disclaims any liability or responsibility regarding them.
- Subject to applicable laws, Oshi reserves the right, without incurring any liability to you, to:
- Modify, remove, cancel, suspend, disable, or discontinue Oshi's platforms and applications or change any of its features, components, or content.
- Decline, suspend, cancel, reverse, void, or partially execute any purchase.
- Furthermore, subject to applicable laws, Oshi may suspend, restrict, or terminate your access to any or all of our services and deactivate your account in cases including but not limited to:
- Compliance with legal requirements, court orders, or governmental authority directives in any jurisdiction.
- Reasonable suspicion of your breach of these Terms or attempts to circumvent them.
- Reasonable suspicion of fraudulent or erroneous transactions.
- Reasonable suspicion of account compromise or fraudulent use of services.
- Reasonable suspicion of money laundering, terrorist financing, fraud, or other financial crimes.
- Reasonable suspicion of involvement in fraudulent or illegal activities, such as Ponzi schemes, pyramid schemes, phishing, or dark-net transactions.
- Involvement in pending litigation, investigations, or government proceedings.
5. Terms of Use for Creators
- By using our app or website as a Creator, you agree to these terms. Please read them carefully.
- We charge a fee of 20% of all Listener Payments made to you (exclusive of any VAT), known as Our Fee. The remaining 80% (exclusive of VAT) is your Creator Earnings.
- Our Fee covers the costs of providing, maintaining, and operating Oshi, including storing your Content. Our Fee is deducted from Listener Payments, with Creator Earnings paid as described in the Payouts to Creators section.
- To set up a Creator account, navigate to your Profile Page on Oshi and select "Set up creator account" or "Earn money". This process involves working with Stripe for payment processing.
- On Stripe's website, create your Creator account by uploading a valid ID, payment details, and bank account information. If VAT registered in Europe or the UK, provide a valid VAT number. Additional information may be required based on your location.
- After setting up your Creator account, you can charge Listeners a fee for content access by setting a subscription price.
- If you lose account access, reset your password using the email address used for account setup. Additional identification may be required if the email address is unknown.
- Listener/Creator Transactions are governed by the Standard Contract between Listener and Creator. We facilitate these transactions but are not a party to the contract and are not responsible for the transactions. Listener Payments are exclusive of VAT.
- Upon confirmation of a Listener/Creator Transaction, you must perform your part (e.g., allow Listener access to paid content). Failure to comply results in your indemnification for any loss or damage we incur.
